If you are accessing the Services as an Aesthetics HQ registered healthcare specialist, professional, provider, organization, or agent thereof (each a “Provider”), that has agreed to the Provider Terms of Service or as an employee or authorized end user on behalf of a Provider (an “Authorized End User”) your use of the Services is at all times also subject to our Provider Terms of Service. If you are an individual that has created a free Aesthetics HQ client account to access the Services in order to explore Providers, book appointments or take similar actions (“Clients”), your use is at all times subject to the Client Terms of Service . Providers, Authorized End Users and Clients are also subject to Aesthetics HQ’s Website Terms of Use. The Website Terms of Use, Provider Terms of Service and Client Terms of Service, are each hereby incorporated by reference.

We may collect or receive the categories of personal information listed below, which may depend on the Services you use, whether you are a Provider or Client, and your device and account settings. Not all categories of personal information will be collected or received about every user.

  • Commercial information such as Client appointment histories, appointment dates and times, and subscriptions purchased by Providers;

  • Device and Online Identifiers, such as IP address, device identifiers, and identifiers associated with cookies;
  • Internet or other electronic network activity and web analytics, such as information about how you use, access, or interact with the Services, our Website or mobile applications, including Client and Provider interaction with the Website and Services, referring webpage through which you accessed the Website;
  • Geolocation information, such as location information derived from your interactions with the Services, subject to the settings on your device or browser;
  • Communications, such as communications with our chatbot, call logs, calendar information, and content of emails and text messages where Aesthetics HQ is party to the exchange;
  • Supplemental information you provide as part of your Client account, such as skin type;
  • Supplemental information you provide as part of a Provider account, such as state licensed to practice, NPI number, entity name, provider names and biographies, information about your practice and providers, professional licenses, educational history, specialties and certifications, services offered and before and after photographs;
  • Records of communications with our customer support team for training and quality assurance purposes;
  • Inferences regarding your preferences or other characteristics, drawn from and related to browsing patterns, behaviors and services requested or reviewed; and
  • Other personal information, such as health information including records of Providers that Clients book appointments with, appointment dates, types of appointments, dates of visits and before and after photographs.

HOW WE COLLECT INFORMATION (SOURCES OF INFORMATION):

Information Provided Directly by You.

You actively provide information to Aesthetics HQ in various ways while using our online Services. For example, you share information when you:

  • Purchase a subscription to our Services (Providers only);
  • Create a Client or Provider account on our Website or through our mobile app;
  • Request to book appointments with Providers;
  • Request information about our Services where we collect additional personal information;
  • Upload Client data or Provider data, images, photographs and other materials to your Client or Provider profile or account, as applicable;
  • Request customer service or contact us by sending us a message through our online AI chat feature;
  • Submit information through the Contact Us link on our Website or email us directly.

Automatically Gathered Information.

Aesthetics HQ automatically tracks certain information about you based upon your behavior while using the Services. This information is used to better understand and serve you by responding to your particular interests and needs.

Usage Details.

When you access and use the Services, we may automatically collect certain details of your access to and use of the Services, including traffic data, date and time you access the Services, the number of links you click within the Services and any third-party website and sections within the Services that you access.

Device Information.

When you access the Services, we may collect information about your device and internet connection, including the device’s unique device identifier, IP address, geolocation, operating system, type of mobile device you use, browser type and network information.

Use of Cookies (or mobile cookies).

Our Services use cookies to enhance the user experience while using our Services. Cookies are pieces of information that some apps and websites transfer to the computer or mobile device that is browsing that app or website and are used for record-keeping purposes by many apps and websites. Use of cookies makes web browsing easier by performing certain functions such as saving your passwords, saving personal preferences regarding your use of the particular app or website, and ensuring that you don’t see the same advertisement repeatedly. Information Provided by Our Service Providers.

We may use third party service providers to provide us with analytics on Website traffic and use of the Services. Aesthetics HQ uses analytic tools to analyze the performance of our Website and Services as well as how visitors use our Website and Services including:

To opt-out of being tracked by Google Analytics across all websites visit http://tools.google.com/dlpage/gaoptout. We may also collect information from the government or other public records as part of our onboarding and verification process of Providers.

HOW WE USE YOUR INFORMATION AND OUR COMMERCIAL OR BUSINESS PURPOSE FOR DOING SO:

Generally.

We use your personal information for our commercial and business purposes including:

  • Providing and Supporting our Services:
  • creating and maintaining your Aesthetics HQ profile and account;
  • provide the functionality and Services requested or subscribed to;
  • assist Clients in booking appointments with Providers;
  • provide information about Providers and the services that they offer;
  • producing invoices for Provider subscriptions;
  • provide users with a tailored experience when using our Services;
  • enhance functionality of our Services;
  • providing analytic services.
  • Communicating with you about our Services:
  • provide users with customer service and technical support;
  • sending appointment reminders and follow-up reminders;
  • responding to correspondence we receive from you directly, through our contact us page and through our chatbot.
  • Providing advertising and marketing services including:
  • sending email and SMS marketing communications with content we think will interest you;
  • marketing and selling our Services.
  • Improve, monitor, personalize, and protect our Services including:
  • Understanding your needs and interests, and personalizing your experience with the Services and our communications;
  • Troubleshooting, testing, and research, and keeping the Services secure;
  • Confirmation and verification of Provider credentials;
  • Investigating and protecting against fraudulent, harmful, unauthorized, or illegal activity.

  • Auditing our internal processes for compliance with legal and contractual requirements and internal policies.

  • Preventing, identifying, investigating, and deterring fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

Some processing may also be necessary to comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities, and other legal obligations such as to keep records of transactions.

Payment Information.

If you are a Provider purchasing a subscription to the Services, we use third-party payment processors, (currently Stripe), to process your payments. These third parties will collect the information necessary to effectuate your transaction with us, such as credit/debit card number, security/CVV code, and expiration date. Our payment processors may handle your payment information in accordance with their own privacy policies. Aesthetics HQ does not have access to your full payment information.

Marketing and Communications.

From time to time your personal information, such as your name, phone number, email address or mailing address, may be used to contact you with promotional materials, newsletters, marketing or other information that may be of interest to you based on your preferences. You may be contacted by the phone number or e-mail address you provide to us.  We may contact you in this way based on our legitimate interest in undertaking marketing activities to provide you with the most up-to-date information on our Services and other products and services you may be interested in based on your preferences. By providing your contact information you have opted-in to receive direct marketing and commercial information by means of electronic communication (SMS, e-mail, telephone). You can withdraw your consent to receive any direct marketing communication from us by contacting support@AestheticsHQ.com or following the opt-out instructions in our email communications.

Non-Personal Information.

We may collect and create de-identified and aggregated information and other non-personal information, which is not related to an identified or identifiable natural person (“Non-Personal Information”). You agree that Aesthetics HQ owns, without restriction, all Non-Personal Information and that you have no rights in or to any Non-Personal Information. Because Non-Personal Information cannot be used to personally identify you, you agree we may use such information for any lawful purpose.

HOW WE SHARE YOUR INFORMATION:

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Aesthetics HQ’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Aesthetics HQ’s about our Website users is among the assets transferred.
  • To fulfill the purpose for which you provide it. For example, if a Client requests an appointment with a Provider, we will share the Client’s name, email address, phone, date of birth, procedure requested and appointment date and time requested with the Provider.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To enforce or apply our Terms of Use, Provider Terms of Service, Client Terms of Service and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Aesthetics HQ, our Clients, Providers, or others.

Aesthetics HQ has does not sell or share your personal information with third parties.

Legal Requirements.

As we may determine in our sole discretion, we may disclose personal information if required to do so by applicable law, including, without limitation, responding to a subpoena or request from law enforcement, court, or government agency, or in the good faith belief that such action is necessary to: (i) comply with a legal obligation; (ii) protect or defend our rights, interests or property or that of third parties; (iii) prevent, investigate, or identify possible wrongdoing in connection with the Services; (iv) act in urgent circumstances to protect the personal safety of Clients, Providers, or other third parties; or (v) protect against legal liability. 

HOW WE PROTECT THE PRIVACY OF CHILDREN ONLINE:

We understand the importance of protecting children’s online privacy. Our Website is not directed to individuals under the age of 18, and Aesthetics HQ will never knowingly collect or maintain personal information through our sites from anyone under the age of 18. If we learn that we have received information directly from a child who is under the age of 18, we will delete such information as soon as possible.

INFORMATION RETENTION:

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was collected. The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide services to you (for example, for as long as you have an account with us or keep using our services) and the length of time thereafter during which we may have a legitimate need to reference your personal information to address issues that may arise;
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
  • Whether retention is allowed by applicable law (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

When we no longer need to process your personal information for the purposes set out in this Privacy Policy, we will delete your personal information from our systems.

SECURITY:

Aesthetics HQ uses technical, administrative, and physical measures to protect your personal information against accidental or intentional destruction, loss, alteration, unauthorized disclosure, or access and against other unlawful forms of collecting and processing. Aesthetics HQ follows industry standards and practices to help protect the confidentiality and integrity of your personal information that is collected and processed.

THIRD-PARTY SERVICES:

In general, the third-party providers used by us, if any, will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your information will be handled by these providers.

Our Services may contain links to other websites, applications, and services maintained by third parties in which case the privacy policy of such third party applies and this Privacy Policy does not apply. The information practices of such other services are governed by the third-party privacy policies, which we encourage you to review to better understand those third parties’ privacy practices.

ELECTRONIC MARKETING AND COMMUNICATIONS:

From time to time your personal information, such as your name, phone number, email address or mailing address, may be used to contact you with promotional offers, newsletters, marketing or other information that may be of interest to you. You may be contacted by the phone number or e-mail address you provide to us. We may contact you in this way based on our legitimate interest in undertaking marketing activities to provide you with the most up-to-date information on our Services and other products and services you may be interested in based on your preferences. By providing your contact information and opting-in, you are consenting to receive direct marketing and commercial information by means of electronic communication (SMS and e-mail). The frequency of the messaging may vary based on your preferences. Message and data rates may apply. You can withdraw your consent to receive any direct marketing communication from us by contacting support@aestheticsHQ.com or following the opt-out instructions in our email and/or SMS communications, as applicable.

CAN-SPAM ACT:

We are committed to being compliant with the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (“CAN-SPAM Act”). All e-mails you receive from Aesthetics HQ or through the Service are intended to fully comply with the CAN-SPAM Act.  If at any time you would like to unsubscribe from receiving future e-mails, you can e-mail us at support@aestheticsHQ.com and we will promptly remove you from all correspondence for the Website and Services. You understand and agree that being removed from all correspondence for the Website and Services may mean some features of our Website and Services may not function properly or may not be available to you, and you may not be able to use all of the Services.

IMPORTANT: Except as stated herein as necessary to carry out Aesthetics HQ’s business purposes and to provide the Services, we do not sell your personal information to any third parties, including but not limited to advertisers, strategic partners or vendors.

INTERNATIONAL USERS:

If you are visiting the Website from outside the United States, please be aware that Aesthetics HQ is based in the United States, and the information we obtain through the Website will be transferred to, processed in, and stored on our servers in the United States and other countries where our service providers operate. The data protection laws and regulations applicable to your personal information transferred to the United States and such other countries may be different from the laws in your country.

ADDITIONAL STATE SPECIFIC PRIVACY RIGHTS:

Except as otherwise provided, this section applies to residents of California, Colorado, Connecticut, Utah, Virginia, and other states where privacy laws applicable to us grant their residents the rights described below.

For purposes of this section, “personal information” has the meaning given to “personal data,” “personal information” or similar terms under the applicable privacy laws of the state in which you reside.  Please note that not all rights listed below may be afforded to all users and that if you are not a resident of the relevant states, or the laws do not apply to us, you may not be able to exercise these rights.

California

The CCPA and CPRA provides California residents with specific rights regarding their personal information. This section describes your rights and explains how to exercise those rights.

Right to Access and Right to Know.

You can request access to a copy of the personal information that we have about you, including a list of categories of your personal information that we have collected and used over the past 12 months. We will provide to you the following information (to the extent required by law):

  • The categories of personal information we have collected about you.
  • The categories of sources from which we collect your personal information.
  • The business or commercial purpose for collecting or selling your personal information.
  • The categories of third parties with whom we share your personal information.
  • The specific pieces of personal information we have collected about you.
  • The categories of personal information that we have disclosed for a business purpose, along with the category of any other company we shared it with.
  • The categories of personal information that we have sold, along with the category of any company we sold it to. If we have not sold your personal information, we will say so.

Right to Information Portability.

You can request the transfer of your personal information to you or to a third party. We will provide to you, or a third party you have chosen, your personal information in a commonly used, machine-readable format.

Consistent with applicable law, you may submit a verifiable consumer request to correct inaccuracies in your personal information held by Aesthetics HQ.

Right to Deletion.

You have the right to request that we delete the personal information that we have collected and retained, subject to certain exceptions. Once we receive a request, we will delete (to the extent required by law) the personal information we retain about you and direct any service providers to do the same. If we determine that an exception applies, we will inform you of the reason for denying the deletion request. In some cases, deletion may be accomplished through de-identification.

Please understand that if you request us to delete your personal information, our subsequent removal of such personal information may impact your ability to use our Services, and may limit your use of or participation in our Services that require your personal information.

Right to Opt-Out of Sale of Personal Information.

You have the right to opt-out of the sale of your personal information, however, we do not “sell” your personal information as that term is defined under the CCPA. However, we do process personal information for purposes of displaying material that are selected based on users’ online activities on our Website. We also engage in automated processing that could affect you. Consistent with applicable law, you may opt out of such processing by using the contact details in the “Contact Us” section.

Limit Use and/or Disclosure of Sensitive Personal Information

Certain categories of personal information that we collect and use might be “sensitive” under data privacy laws. Consistent with applicable law, you may limit certain uses or disclosures of your sensitive personal information and may exercise this right by using the contact details in the “Contact Us” section.

Right to Non-Discrimination.

We will not discriminate against you for exercising any of your CCPA rights. This generally means we will not deny you goods or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality of goods.

Verification of Requests.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. The CCPA requires that we verify the identity of each person who makes a request to know what personal information we have about you or to delete the personal information we have about you.

You may request this information no more than two times in a rolling twelve-month period. When you make this request, the information provided may be limited to personal information we collected about you in the previous 12 months.

All requests must provide sufficient information to allow us to reasonably verify you are the person whom we collected personal information about or an authorized representative of such person. We will only use the information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Please describe your request with sufficient detail to allow us to properly respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

De-Identification

Consistent with applicable law, we commit to maintain and use anonymized information in de-identified form and not to attempt to re-identify the information, except that we may attempt to re-identify the information solely for the purpose of determining whether its de-identification processes satisfy the requirements of the California Privacy Rights Act.

Do-Not-Track Disclosures; Third-Party Tracking

Certain mechanisms may allow you to send web browser signals, known as “Do Not Track” (“DNT”) signals, indicating your choice to disable tracking on websites. We do not respond to browsers do not track signals currently. We may not be aware of or able to honor and respond to every such mechanism. Third parties, other than our service providers, do not have authorization from us to track which websites, apps, or other online services you visit prior to and after visiting our websites. Please note, however, that we cannot control third-party tracking and there may be some third-party tracking that occurs without our consent or knowledge.

California Civil Code § 1798.83 permits residents of California to request from Aesthetics HQ a notice disclosing: (1) the categories of personal information we have shared with third parties, if any, for the third parties’ direct marketing purposes, during the preceding calendar year, and (2) the names and addresses of those third parties.
